With guns covered and Helicopter stowed even if its pre meditated it still is innocent passage.
The same cannot however be said for the Russians when they pass through the channel, guns are not covered but helos are usually stowed, the Russians also follow commercial traffic lanes when transiting and are in constant contact with VTS.
The reality is we have been doing this to each other for a very long time so its quite expected.
